Kulongoski OKs cold-medicine limits

Prescription law will be implemented by July, likely sooner

PORTLAND -- Gov. Ted Kulongoski on Tuesday signed legislation that will make Oregon the first state to require prescriptions for cold and allergy medications that can be converted into methamphetamine.

The requirement applies to any medication containing pseudoephedrine, the key ingredient in the highly addictive street drug.

"This is a tremendous start, but we must recognize that it is just that, a start," the governor said. "We have a long way to go."

Kulongoski said that he was aware of inconveniences that might arise from having to get prescriptions for commonly purchased remedies but said pharmaceutical companies already are producing replacement remedies that don't contain pseudoephedrine.

The governor also signed a bill increasing the penalty for drug crimes involving children and bills for funding drug courts, related corrections expenses and other costs.

The prescription bill sailed though both houses of the Legislature, opposed by a handful of lawmakers who said it would be an inconvenience to their constituents to need prescriptions for common medicines such as Sudafed and Claritin D.

The state Board of Pharmacy has until July to implement the prescription requirement, but the board's executive director, Gary Schnabel, said it could be in place within three months.

Oregon and several other states already require consumers to show identification and sign a log when obtaining these cold and allergy medicines from pharmacies, and Congress is moving toward similar restrictions.

Sen. Ginny Burdick, the chairwoman of the Senate Judiciary Committee, argued that current regulations moving the medicines behind the counter don't work.

She said that, as an experiment, four legislators in Salem were able to buy enough cold medication in a few hours to make as many as 200 hits of meth.

The real victims of the new legislation, she said, are home meth cooks, "and that's the way it should be."

Yep, now if I want a bottle of Nyquil, I'll have to schedule an appointment with my doctor, drive to his office, pay a copay on my insurance, wait for him to see me, get a prescription, then drive to the store and wait at the pharmacy to purchase it. So, the $4 bottle of medicine now costs me $20, plus whatever it's going to cost once it goes behind the counter....not to mention my time. It becomes an even better situation for those without insurance. Fortunately, it's well worth it, as all of the home grown meth labs in Oregon will be just a bad memory.

Although I am questioning such legislation in Oregon (like I've ALWAYS questioned their particular legislation, this isn't the first insane law they've passed) I did find this article quite the eye opener.

Oh, incidently, this wasn't a federally-mandated law, it was a state law by choice. If you don't like it, vote 'em out, SOB.

I'm in Oregon, and it's a pretty nice state, but every place has its quirks.

Some of the things we have going that are positive:

1. Doctor assisted suicide for the terminally ill.
2. Medical marijuana.
3. Great roads.

Some not so great stuff:
1. The state has bleach in the water supply. It seems all white.
2. This dumb pseudophedrine law.
3. Income tax.

It's a great place to live, but you gotta stay vigilant.
