I'm 37, i didnt owned or fired a real gun, absolute no need here.
But after seeing the news, in N.O. i wouldnt walk around without a weapon (gun).
Looks like at war, very very dangerous. And i can understand both
sides the PD and the citizens.

Well ghost, if you were in N.O you would be prey then. The guns are only a symptom of a bigger problem in N.O.

I don't think we should be suprised by what happened.

In a city where police cannot operate to hold the criminals in check (in this case because of the hurricane), this stuff is a natural result.

It was in a live interview this morning on CNN. Check their website you might be able to "verify" what I quoted him as saying. I would imagine they will replay it numerous times. At least they have every thing else.
 I have a pretty fair grasp on the language. :) I quoted him and didn`t even need someone to translate it.

New Orleans has been under a form of Martial Law since Last week. It's why the National Guard/swat/police have been able to shoot to kill and have killed over 50 thugs.

It's called State of Emergency, it gives police/gov't a lot more power than normal.

Louisiana state constitution doesn't allow for True Martial law, but it's close enough.

I live outside of New Orleans and the local news explained it all.

According to this marshal law has not been declared.
  If it was declared I beleive the PD Superintendent would be completely out of the loop and as of now he certainly doesn`t have the power to rewrite laws.

Q. Has martial law been declared in Louisiana?

A. No.

"People are using that term far too loosely," said Duke University School of Law professor Scott Silliman. "Martial law can only be imposed by a governor or the president of the United States when there is a total absence of any governing authority (meaning no courts, etc). Martial law allows the federal military to come in to preserve the country."

This has not happened.

Q. Who declares the authority to forcibly remove residents in New Orleans?

A. Louisiana Gov. Kathleen Blanco.

The governor is given broad authority under the Louisiana Homeland Security and Emergency Assistance and Disaster Act. It allows her to "direct and compel" the evacuation of all or part of the population from any stricken or threatened area within the state if life is at stake or if such evacuation is necessary for the mitigation of, response to, and recovery from a disaster.

A public health emergency prompted Gov. Blanco to declare a state of emergency on August 29, 2005. The declaration allows her to use the National Guard for purposes including law enforcement. Note that she does not have the power to use federal troops; only the National Guard. This police power is always found in state law and can be used for public health emergencies when lives are in danger. Gov. Blanco also has the authority to direct New Orleans Mayor Ray Nagin to use the National Guard and police to forcibly remove New Orleans residents because of the public health dangers arising from toxic waters, Silliman said.

That's what i'm talking about.

The rule books go out the window under her declaration of emergency. They can impose on freedoms and they can kill looters on sight if the looter won't cooperate. But once the city is no longer under emergency, wrongful shootings will be investigated.

It's similar to martial law it's just that it's the national guard and not the US Army doing it. IE Freedoms being taken away.

It also allows police to do whatever needs to be done.

As I said, Louisiana State Consitution doesn't allow True Martial Law. They would have to amend it. This is as much Martial Law as the state constitution allows.

If martial law had been declared or COULD have been declared the police wouldn't even be arguing with that guy in the pic, he  would already have been hog tied and thrown in the truck. To me the answer is simple, if those idiots want to stay there LET THEM, they are obviously not smart enough to deserve the right to live with the rest of the world. I don't know when the US decided it would start to do anything it could to save stupid people. If you don't have enough common sense to leave there if you can then you really deserve what happens to you if you don't. Lets get real here for a min, the people of NO knew about the hurricane, its not like it popped up in mid of the night, all the intelligent people grabbed there important stuff and left when they were still calling it a very strong level 5 cane. This situation would have been so worse if the hurricane would have stayed a 5 and not dropped to a 4 when it did.
