Ah but you see Vulcan, she put the word "recovering" in front of her "addict" title. She claims she was clean before and during most of her pregnancy, and that only towards the end (but before giving birth) did she give in to her addiction again. She also claims to have been clean since. Since no one was testing her before, and no one was testing her after, until the baby died and an autopsy was performed, we have only her word on when she started using again, and when she stopped.

and in that case you have to take her word for it. you can't convict people because they can't prove what they say, you have to be able to prove they are lying.

it's not a perfect system but considering the alternative it's the better way to go.

I doubt we'll ever find a perfect system that convicts every person who commits an evil act while never convicting an Innocent one. until we do I'd rather error on the side of having the occasional scumbag get away with their crime than having innocent people victimized by our legal system simply because they couldn't prove allegations made against them were false, guilt needs to be proven.

it's not perfect, but as with most choices in life you don't get the option to make a good choice. usually you get to try and choose the best of the crappy options available to you.

legit question - in establishing the pregnancy did she not get a checkup? ie urine and blood tests done?

You seem to forget that abortion is only legal untill a certain stage of pregnancy. After that the fetus is developed enough to potentially suffer from the abortion.

Late term abortions are only done in grave medical necessity in cases where the child or the mother would die without it anyway.

Where the anti-abortion people go wrong is that they make no difference with boiling and eating a fertilized egg and boiling and eating an egg with an alive and functional chicken fetus inside.

The latter I would consider extremely crude while the previous I've often done myself with not a thought on it. In case you wonder, we have a natural chicken house that does produce also fertilized eggs.
