Richards pointed out that Utah law says minors under age 14 do not have the ability to consent to sexual activity.

    "It's a paradox," he said.

"How can they be old enough to commit an offense if they're not old enough to consent to it?"

Suave,

The judge is not responsible for the content of the laws. That is the responsibility of the legislature. The judge is just stuck with dealing with them as written.
DEFINITION OF A VETERAN
A Veteran - whether active duty, retired, national guard or reserve - is someone who, at one point in their life, wrote a check made payable to "The United States of America", for an amount of "up to and including my life."

Is it stupid to enforce a stupid law? Or just an aversion to civil disobedience?

The judge's responsibility is to deal with matters brought to his / her court and rule on them according to written law.

My guess is the concept that a minor under 14 cannot consent to sexual relations is intended to prevent a defence by a pedophile claiming that it WAS consentual on tha part of the juvinile. It is a legal situation set by the legislature, not the judge.

The judge may refuse to hear the case by excusing himself but it will simply go to another judge. Refusal to hear cases may also be grounds for removal of the judge from the bench. Again, they are not responsible for the content of the law. They ARE responsible to hear the cases brought before them.

My question in this case is not regarding the juviniles. My question is what about the responsibility of the parents of each of the kids.

Right on my Finnish friend....however, in this country it's our collective fault for all of this crap. We do not pay attention to those we elect and we continue to allow them to remain in office rather than getting involved and removing them from office.

My country has changed alot in the last 50 years.

You are so right Rude.

It has changed a lot in just the past 20!  I remember going duck hunting before school back in the 80's, coming to school, and carrying my shotgun (in a soft case) into the principals office so it did not get stolen out of my car during the day.  Funny thing is, they'd leave the ducks in a cooler alone!  Try that now, you'd be gunned down before you pulled it out of your car.

We really all need to get together and toss 90% of these idiotic legislators out on their collective ears and put in people who care about the country's future for all instead of the priveledged few.
I regret doing business with TD Computer Systems.
