A man serving a life sentence for the murder of his wife is asking a federal judge to order the state to pay for a sex change operation for him, saying that denying him the surgery amounts to cruel and unusual punishment. A psychiatrist testified yesterday that he believes Robert Kosilek will kill himself if state correction officials refuse to allow the surgery.

Kosilek, 57, was convicted of strangling his wife, Cheryl, in 1990.

In 2002, US District Judge Mark Wolf ruled that Kosilek -- who now goes by the name Michelle -- was entitled to treatment for gender identity disorder, but stopped short of ordering the state to pay for the sex change operation.

Since then, Kosilek has received psychotherapy, female hormone treatments, and laser hair removal.

Kosilek, who wears his hair long and tucked behind his ears, has developed larger breasts since beginning hormone treatments.

Kosilek sued the Department of Correction for the second time last year, saying that numerous psychiatrists who had examined him -- including two of the department's specialists -- had determined that a sex change operation is ``medically necessary."

``We ask that gender identity disorder be treated like any other medical condition," said Kosilek's attorney, Frances Cohen.

Kosilek sat quietly yesterday as his attorney and an attorney for the Department of Correction made opening statements in a trial that is expected to last up to two weeks.

The Department of Correction attorney, Richard McFarland, said that Commissioner Kathleen Dennehy made the decision to deny surgery based on ``significant safety and security concerns."

Neither side gave an estimate on the costs of the sex change operation.

Dr. George Richard Brown, a psychiatrist who said he has treated more 1,000 patients with gender identity disorder, was asked by Kosilek's attorney what would happen if Kosilek does not have a sex change operation.

``I believe that she would kill herself," he said

It scares me that,

a) This made the news, right next to Brangelina's baby, Iran talks, and HIV in Kenya.

b) Taxpayers foot the bill for a man to be perscribed female hormones and laser hair removal.

c) This even makes it to court.

d) (s)he'll probably win and get the surgery.


and here I was thinking being too short & fragile for jail was absolutely ridiculous...

Not medically necessary to continue life. Suicide threat is not a basis of a medical necessity. If it decides to off itself, AMF.

No reason to expect the taxpayers to pay for an optional procedure.

Where do we send donations to help this person (he or she or it)?  I think its unfair that people like this in prison cant get the necessary medical help when they so desperately need it...

I think I can send some shoelaces or razor blades...would that help?:t

I'm sure his dead wife, and her family, will feel that justice is well and truly served by making sure that it's happy with it's sexual identity.  Especially when they'll get to help foot the bill.

Really now, how insensitive can society be?  Doesn't a stone-cold strangler deserve to be happy?  Cod forbid that a convicted killer be miserable and unhappy while being punish....err, 'rehabilitated'.

Frankly, how could it even matter in jail?  If he wants some jailhouse jollies, he doesn't need an operation...just a sign.

If it were up to me, it and it's lawyer would both do a coupla years hard labor just for the sheer stupidity of the demand.

Mr. and Mrs. Kosilek, your son has accidentally died in his sex change operation.  For some odd reason, his heart experienced a whole bunch of inexplicable cuts.  He died shortly after.

funny story about BLTs.

two years ago went to South Carolina for christmas.  Stop at a Shoney's for lunch.  My son Daryl (AirDude) (13 then) wants to show how adult he was and wants to order his own lunch from the menu.   Now Daryl is pretty much just a meat and potatoes guy right now, so I see him point at the menu and tell the waitress "I want that right there but no lettuce and tomato."  
"How bout maynoiase hon"  "No maynoiase"
so few minutes later waitress comes back with our lunch and hands Daryl his plate and I see two pieces of toast with some bacon sandwiched between them.  :lol  and he has the real sad :huh :( :confused:  face.  I asked him what he ordered, thinking maybe the waitress messed up the order.  He said he thought he ordered a Bacon/Hamburger.   I said show me the menu and what you ordered.
He points at the BLT :rofl  He stuck with it though and ate it.
