Suit over illegals OK'd for workers at Tyson Foods

A federal judge has ruled that workers can file a class-action suit against Tyson Foods Inc. for depressing wages by hiring illegal aliens.
Howard W. Foster, a Chicago lawyer for the Tyson employees, described the ruling in Winchester, Tenn., as a "very big step," allowing him to seek damages for thousands of workers at eight plants -- including one in Glen Allen, Va. -- instead of just the four original plaintiffs.
The case, filed in 2002 under the federal Racketeer Influenced and Corrupt Organizations Act (RICO), is one of a growing number across the nation challenging illegal aliens in the workplace. In August, a temporary agency in California sued its competitors under the state's unfair-competition laws.
Mr. Foster has represented U.S. citizens seeking damages for wage depression caused by employment of illegal aliens in other cases, including one against Mohawk Industries and a class-action case against Zirkle Fruit Co., which has been settled.
"You can't bring these cases unless they get certified as class actions," he said yesterday. .

Good news indeed. The agricultural industry can't just relocate to poor countries for sweat shop labor like a lot of industries can.

aren't there laws against hiring illegals?   I bet arresting the owners of tysons and throwing them in prison would have some effect too.

Pass english only laws... arrest employers and.... no benifiets for non U.S. citizens.  wouldn't even need a wall.

There is a big lawsuit of the same type against mohawk in dalton, GA. I think some of the big companies are going to start feeling the repercussions of their actions.

Likely so, but what's truly infuriating people here in the states is that BUSINESSES who pay illegals under the table, or wink at their fake i.d.'s, don't have to pay the social costs of these parasites that the taxpayer faces---when these people get sick , they go to the emergency room... many of them manage to get some sort welfare/food stamps, etc....their children have to be absorbed into the local school system... they occupy an  VERY high % of cell spaces in jails and prisons, and they listen to chitty music VERY loud:confused:

Yea but not all Mexicans are illegals.

Tell ya what though.
Normally Im not a snitch and typically I hate snitches but..
For the amount of friggen hoops I had to go through here to get my conractors licence.
And for amount of contractors operting here both without a licence and with illegals.

I'm going to be turning in each and every one I find.

They should hold our elected officials to such high standards

I'd known a couple of illegals though various jobs.  Most of them learned or were learning english, kept their nose clean and worked hard.

I'd prefer them to some of the folks that distinguished themselves during the new orleans katrina disaster.

True that.

Maybe there should be a law that empoyers can't pay anybody less than minimum wage, even if they're here on a work visa.

Might cut down on the demand for illegal labor, but only if the law is enforced.

Don't you mean the opposite? That employers can pay wages lower than minimum wage to eliminate the demand for illegal aliens?

The problem is not illegal aliens; the problem is government. Every government agency has the tools and regulations to stem illegal employment. You have ask who is influencing them to not enforce those rules. You'll find it is not illegal aliens compromising the integrity of legislation and administration of government, it's US businesses.

And lying about thier income because they're being paid under the table, and getting welfare/foodstamps and other benefits they shouldn't be getting.

My mom works for family and childrens' services, and she's said a few times that you would not believe the number of fraudulent cases they have with hispanics trying to get benefits.  They'll sit there in her office and lie through thier teeth about anything and everything trying to get a government check.
