This is crap, and I can't believe the judge applied the law in this way.  Is he saying that if there had never been a previous case of trespassing within a mile of this occurrence then Amtrak/NS would not have been at fault?

Under Pennsylvania law, the duty owed by a possessor of land to a trespasser is to
refrain from willfully and wantonly injuring the trespasser.

In this case, the defendants intentionally parked the freight cars, intending to leave
them for several nights, under energized power lines. Furthermore, Amtrak knows of the
danger posed by humans coming in contact with catenary wires and trains their employees
accordingly. Amtrak also knows that the area within a mile in each direction of the site of
the accident had been trespassed sixty-nine (69) times during the three years before the
accident. Of these trespasses, at least thirty-three (33) involved juveniles, with at least
seventy-eight (78) juveniles mentioned. Although the defendants did not have a duty to
anticipate the plaintiffs trespassing onto the Amtrak right of way and climbing to the top
of the train, there is a genuine issue of material fact whether the act of parking the freight
cars on that particular tail track would lead a reasonable person to conclude that a high
probability of harm existed.

i am always amazed at how many stupid people there are in this world.

my little riding mower has warning stickers all over it, "don't do this, don't touch that", my big 60 year old IH farm tractor has no warning stickers at all, i guess people were smarter back then.

Guess they need to be more carefull picking the Jury.  Getting dumb people is always a chance.

The funny thing is, they call these 'Frivolous' lawsuits. What's so frivolous about 24 million dollars?

The kids' parents' shoulda been made to foot the bill. What utter wastes' of breathable air.

On Friday, May 29, 1981, the nation's press reported an $8.5 million settlement paid by Consolidated Rail Corporation (Conrail) for a sixteen year old San Jose boy, Steven Throop.

Thirteen year old Steven suffered severe electrical burns on July 4, 1978 when he climbed upon a boxcar parked on Conrail's mainline in Washington, D.C. The accident happened within yards of the National Air and Space Museum and the Smithsonian Institute.

Accidents like Steve Throop's are not new to Conrail, a quasi-federal corporation created to handle freight by the authority of the Regional Rail Reorganization Act of 1973.

On average, 24 deaths/major injuries per year have been suffered by children as a result of Conrail's overhead electrical catenary system
and the failure of the Federal Railroad Administration to demand appropriate warnings and fencing systems.

  Pretty soon folks who make power tools like drills etc, will not supply a power cord due to the risk of someone wandering into a pool of water. "Power cord not included do to risk of injury or death. Plugging in this device is the sole risk of user."

I think we need to outlaw warning labels.  It's time we cleaned out the genetic gene pool with some heavy chlorine. 


If you're not smart enough to know that you don't grab onto electrical wires that feed trains...  Not only will no help be given, but your family will be broadcasted publicly to humiliate them for raising a handsomehunk.
