So basically anyone can write any rule they want and post it,but the 1st ammendment runs this Board, not an individuals opinion. It's like putting up "Enter at your own risk" signs. They mean nothing. The owner is still responsible under the law.

I'm sure someone is going to say "If you don't like it then leave" but like I said, this is a "public" forum and I don't have to. Can you spell A.C.L.U.?

Well your honor I hate to be the one to break the news to you, but this is a public forum without any membership fees or requirements thereby making it a "private" forum. The laws governing the opperation and use of a public forum can be quite strict.  Google it and I think you'll be surprised.  Don't think for a second the people at AH don't know and fully understand the laws governing this BBS.

One final thought. This place (the O'Club) is owned, hosted, and provided by HTC. It's theirs. They have a right to set their own rules and enforce them in the manner they choose. They have twice nearly closed it, and been kind enough to re-open it. Go ahead, call the A.C.L.U. The past history is pretty good at predicting the future. So, when you call the A.C.L.U., by all means, please come here and tell us all how great you are for getting them to "protect" our rights, and what a big favor you did for us. I'm very sure we'll all be falling all over ourselves to express our gratitude when one of the HTC staff responds by pulling the plug on the O'Club permanently. Because closing it will be the most expedient manner to take care of the issue for them. And while the A.C.L.U. may find a judge (read: liberal fool, legislating from the bench) to force HTC to allow people to post here, they won't be able to force HTC to keep the place open, since being closed, it excludes everyone on an equal basis. Congratulations.

one of the weakest arguments people champion is "Freedom of speech"  Freedom of speech is NOT an absolute.  Constitutionally it applies toward government censorship and even that is not an absolute. Yelling "fire" in a crowded theatre being the most cited example.  "Fighting words" being a more recent Supreme Court ruling...

This is a PRIVATE forum because it is hosted by a private company.  Freedom of speech does NOT apply here.  HTC can limit these forums to what they wish to limit them to.
