There's a couple parts to this issue. One is that sort of physical punishment by most modern definitions is considered cruel and unusual. Additionally, it's an indication of there being no equality under the law. One group is being held to different standards than another, which is something that doesn't (or at least, by the letter of the law isn't SUPPOSED to) happen here.
