yea, i think it is. i call it the "shotgun approach".
in 2007, i got a notice i was being sued. it was for a snow plowing job i supposedly did in feb. 2004. a lady drove from pine hill nj to cherry hill nj(that's about 10 miles) in pretty much blizzard conditions. there was close to 2 feet of snow everywhere, and most roads were nearly impassable.
i called the guy i was plowing for, and he had gotten the notice too. along with every business owner in that little strip of stores, the company that owned the building they were in, and the people that owned the company that owned the building, and three other snow removal companies that might've done that lot.
to begin with, i knew i didn't do that lot, because i blew my front differential on the previous snow, and was still waiting for parts. the guy i used to work for represented me, so i didn't have to take time off from my day job.
the lady came in, and blew her own case out of the water, by showing pictures of where she fell. it was ice from the improper downspout. and it was on the sidewalk.
she got thrown out on everything, although the building owners did have to re-do all the downspouts.
