It can and will be considered favoritism and thus discrimination in the court of law as it can be interpreted as "only seachicken fans wearing seachicken regalia are permitted to not adhere to the school's strict dress code policy for one day of the year".  This has happened in places of employment/work with "casual fridays" - either every employe who has to adhere to the dress code gets them or nobody get them.
