I'll never own a Toyota, nor ANY Japanese car.   On my 9th car from Ford Motor Credit in the last 16 years.    Not a single missed payment, one time my wife was a week late on a payment (9 years ago), they ignored the fee when the check came in.   

I've only ever bought one brand new car.....that was back in 83. a shiny black 5.0L mustang(not a gt).

 i hadn't established any credit at that point. mom was afraid to co-sign for me.....grand mom did. the loan went through ford motor credit. they were nothing short of spectacular to deal with.

 i may consider a gt at the end of this year...the re-ignited hp wars are exciting me.


 to the OP........take all of your paper work, and see a lawyer. unless toyota's financial dept is based in va, you may be able to get this cleared up.....depending on the laws where they ARE based.

 i hope it works out for you.....it sucks bad enough to see young people get screwed.....but to see a young person that is serving his country get screwed.........THAT makes my blood boil.

I love watching the military black flag companies around here. Most of them deserve it and their business suffers greatly. Would be nice to see a couple large financial institutions fall to this.
All to often the banks only worry about their bottom lines even after we bail those fools out. We need to get the banks back on the customer service program.


Don't we as a people own the banks now?

A similar story happened to my family about a year ago, only we lost our house.
He's ARNG, served through OIF '05-'06 as a UH-60 Crewchief/Mechanic.
Still receives a corporal's pay grade due to interal f'ups, and his superiors
don't do toejam.

It crippled us.

Just an FYI...  To repo a car they have to send you a "notice to cure default" before taking action.  If they didn't, they're screwed (unless they had sent you one in the last 12 months prior to the repo).  If they held your payments without returning them to your account, they're screwed.  If they sent you the notice, and returned the payments to your account (within 30 days of each payment) before repo, they may have a case.

The info you need is the bank records and the notice to cure default.  If they deposited that money in any of their accounts, that's valididation of payment.  If they didn't send you a notice to cure, then they're in violation of federal lending laws (state doesn't matter).

EDIT:  Also, in the event of a repo, the lender has to give you the option to pay all late payments and fees (which includes repo and impound), then release the vehicle to your possession.  I'm not sure of the Virginia laws as far as the time frame on that is, but it's not long.  In any case, you have options aside from taking out a new loan and keeping the repo on your credit.  Act fast...  Do NOT wait for them to auction your car.  At that point, you'd have to file suit against them, which could take a very long time.

Damn Blue, what a damn infuriating story. I hate you are in a position that effects your job so much. I would not give those bastards a dime and sue them on top of that but I know you may not be able to do that. I really hope this gets better for you soon and never lose sight of the fact you've done nothing wrong. This kind of bs can wear on a guy. Been there more than once :salute

Whatever happened to the soldiers and Sailors Relief act?  I thought this was still in place to prevent this sort of thing, and to give you a strong legal remedy when companies try to pull a fast one.

Thank you for all the information gentlemen. This was more of a story to warn others of Toyota Financial dealings with its customers. I will use the information and ideas given to see if I can sort this out in the end.

Funny story of today with the best of their customer support. I call this morning to obtain information about Western Union. Heres a piece of the conversation. Some background information this gentlemen works for the repocession department and only that. I clarified this before. This guy Ive talked to before and he probably my age and acts like hes top of the world because he gets to repo people's cars.

TF Rep:"What you need to do is just get in your car and drive down to a western union branch..."

I cut him off there: "Sir, what do you mean by my car?"

TF Rep: "The car were talking about now."

By now Im tired of talking to these people and getting no where.

Me: "Sir, are you slow?"

TF Rep: "I dont understand what you mean."

Me: "Sir, you work for the repocession department correct?"

TF Rep: "Yes I do."

Me: "Repo means you take people cars back for whatever reason?"

TF Rep: "Yea kid."

Being called kid took it to the next level. I dont mind being called kid.  But only by those who deserve my respect.

Me: "Sir whats your name again?"

TF Rep: "George."

Me: "Well george, let me explain how this works. You took my car from me. Hence I do not have a car. And you told me to get in my car and go drive down to a branch."

george: "I dont get it."

Me: "George, your slow. Im going to hang up on you now and I want you to sit and think about what I said. When you do figure it out your world is going to be changed forever."

george: "I dont get it."

Me: "Okay george, Im done with you. Thank you tho from the bottom of my heart. You've made me realize that no matter how lousy my situation is, it could always be worse. I could be confused like you."

I hung up and called back and talked to another lady that gave me my info in a few minutes. George made my day. I smiled all day. Small wins at a time.

 on that note....it was pretty dam funny, and glad you were able to find humor in it. i kinda admire how calmly you're taking this....i know i couldn't when i was your age.

I had my moments where I lost it. Me taking my aggression out on the phone wont help me at all, will just get me worked up even worse. In the end Im not dead, hurt, or worse yet any of my friends or loved ones. Things could always be worse. That mindset got me though a few rough times in my career. The whole situation I just classify as a true fubar situation. Things will only get better from here. I tonight I will be praying for george. I hope he didnt have a coronary attempting to figure out what I told him.

This needs to go on national news. Is there a local channel in your area that does reporting regarding fraudulent business practices? You might contact a few of them and have your buddies that are going through the same situation to corroborate the story. Let them broadcast it and tarnish toyota. Frankly if nothing else contact the local newspaper and let them have the story about how they are screwing current and past troops.

Toyota needs their bellybutton handed back to them. I can say they do not have to worry about seeing any of my money.

Have YOUR Mother call HER Congressman.

Play the vet angle. Mention it's happening to lots of vets.

Call a local Virginia TV station. They love juicy investigative scandals and they can play the vet angle.

You never want to deal with them again. Don't. Let others make their lives miserable.

Not only that but I have an aunt who worked for GMAC credit and when I was describing a similar incident with a creditor she told me the last thing I want to do is get rude or nasty with them on the phone.  Apparently your behavior can negatively affect your credit rating.  Apparently being an arnold can cause you troubles too.
