As you can see i was going up instead of pulling over to get ho shot. So I learned the Midway will take the cheap shot anytime.....
honestly, that wasn't a cheap shot at all. It was a perfectly legitimate angle that he took the shot on, regardless of your maneuvering intentions, you presented a perfectly good shot opportunity. The only thing Midway can really be faulted on is the shot grouping, but he's flying a with wing mounted guns so he probably is hitting out of his convergence.
Without the film, would be hard to say what you did wrong but from the screenshots and your own description, it looks like he was able to get under you on the initial merge and used more of a climbing turn instead of going vertical like you did. By going under, he'll be in position to get an angle on you as you went vertical for the 2nd Immelman. It's a counter for a merge when the other bandit is going to go vertical immediately after the merge.
