§ 2305. Justifiable homicide

If a person kills or wounds another under any of the circumstances enumerated below, he or she shall be guiltless:

(1) In the just and necessary defense of his or her own life or the life of his or her husband, wife, parent, child, brother, sister, master, mistress, servant, guardian or ward; or

(2) In the suppression of a person attempting to commit murder, sexual assault, aggravated sexual assault, burglary or robbery, with force or violence; or

(3) In the case of a civil officer; or a military officer or private soldier when lawfully called out to suppress riot or rebellion, or to prevent or suppress invasion, or to assist in serving legal process, in suppressing opposition against him or her in the just and necessary discharge of his or her duty. (Amended 1983, No. 23, § 2.)


Interesting read gents.

As a Canadian, I wish the great white north had some of the "castle" laws which our southern brethren do. I agree that I should have the right to protect myself and property, what scares me is the american litigation system.

I've heard stories of a burglar falling through someone's skylight onto a kitchen knife who then proceeds to sue the homeowner and wins!?  It's unfortunate that there is lawyers writing the law, lawyers interpreting law, and lawyers(judges) enacting the law. I also love how the language of the law is SOOO wide open for manipulation/interpretation.

Example - The Justifiable Homicide -  In the wording posted earlier, it would appear that to satisfy the "requirements" of justifiable homicide, one needs to prove un-measurable metrics.

How does one define a feeling of imminent death, or that the act of JH would definitively prevent the suspect's "attempt to commit". Each of these rules are subject to an event which does not occur. The only clear case is if the criteria has already been met, ie assault has taken place, person murdered.  All other scenarios can be argued, what if?... Mr. KB, are you certain that had you not killed Mr. Doe, he would in fact have committed that rape?..... Well, he had is pants down and she was passed out, but I guess he could have been tucking in his shirt..... WELLLLLL Mr. KB, it appears that you DON'T know Mr. Doe was attempting to commit rape DO YOU!?.... Well I suppose it's possible.... I rest my case Murderer, errr Mr. KB......

edit:  I always thought that rural areas had a low crime rate to begin with. well except for mayberry, they did have a lot of crime for a small town. 





Apparently you don't know about our rural areas. Like the Gila River valley/area which has/is been used as a drop point by cartels. This is an area that we bring along a pistol, AR-15 and our shotguns just to go waterfowling. It can be great waterfowling/quail hunting depending on the precipitation and winter weather. The corridor that stretches in from Pima and other southern counties into our county is a traditional access/launch point to the rest of the US because the interstates connect in Phoenix. All of this, hence you know who Sheriff Joe is...Otherwise, your Mayberry analogy might hold some truth to the rest of the US, here it does NOT. And yes, he has lowered crime by a considerable amount regarding these areas, again, hence you know who he is.

Oh, I forgot to mention, he and our County Attorney are the toughest on DUI's. If you get DUI in Maricopa County, you get to spend a week in our Tent City, regardless of the weather you'll be there, 120 or 20 degrees. On your second, you get to spend a month...YOU DON'T WANT A THIRD. You can also stay free of charge for other offenses against the people of Maricopa County.

get a dui, see what a walk in the park it is  :D.  I have never gotten one myself as I wait till I am sober to go back and buy beer.  I could actually walk to the store since it is a 1/2 a block, but nobody walk sin LA.

hey what happened to the last district attorney you guys had?  didnt he get disbarred last year?  dude the major problem in your county is that those in charge are fighting each other instead of actually trying to serve and that includes your beloved sheriff.

people in power always think they are above the law.  like the guy in the picture said, "nobody is above the law".  anyway  I think the whole infighting thin is childish as it is continuing this thread  :bolt:.

However, I did forget to mention that women are welcome too in Tent City. And we have the only female chain gang (trash pickup) in America  :D

Charles Barkley was also an honorary guest, although he squirmed his way into only a weekend by pleading and "not putting the county through a costly legal battle."

That Tent City is a bunch of BS . That should not be legal . Like animals in a zoo . That's just sick . I don't care what one does to get in jail but they should not be treated like animals .

the majority of those in the tent city are people waiting to go to trial.

it is also celebrating it's 20 years and "A special invocation will be held at noon on Friday. Arpaio is expected to be on hand for that. It will be conducted by Michael Salman, a pastor who is serving a 60-day sentence in Tent City for holding church services at his home without proper permits."

the guy should have gone to jail for fraud but instead does jail for... having an illegal church.
