As an LEO i will tell you that i cant figure out which is more ridiculous. This law suit or nypsy's comment.   :rolleyes: Both are pretty stupid IMHO.

I can't see any possible angle where this lawsuit and the lawyer filing it shouldn't be thrown out on his azz, but this below is BS, it's not reasonable for a cop to get himself brutally injured or killed to avoid using lethal force on a psycho.

Sorry, but if a cop has been injured and is in danger of losing control of his weapon, he needs to do WHATEVER it takes to prevent that.


If every cop who was ever assaulted by a drug crazed mad man wound up having to pull his gun and use lethal force we would have dead people littering the landscape.
The cops excuse that the perp was going for his gun sounds just like what it is, an excuse.

the point is.......no matter WHAT the reason for the 911 call.........the officer could have taken precautions, such as backup. you couldn't pay me enough money to put up with the bs police have to put up with......but considering what their job is, and they KNOW that when they sign on.......based on that alone, this is a pretty ridiculous lawsuit.

 that is the equivalent of me suing you, because i dropped one of your tires on my foot, and broke it.

I dont think this is a case where the officer got out of his car and just started blasting the guy and used a "he went for his gun" excuse.   the officer got into a fight with the guy and he ended up getting beat up himself.  now I dont know about you, but if it was me and I was in a fight like that and I had a gun and I was in either danger of passing out or losing control of the gun, then I would blast the guy away as I would have no other choice.  which is what the officer did.

now what happened during the fight is not why I posted this.  I posted because it is wrong for the officer to sue the woman who called 911 because she didnt warn him that the other guy was dangerous.  it is not like the woman set him up, if that had been the case I would side with the officer and sue the hell out of the woman.

I get into a lot of trouble when I say openly that I wish we could go back to the older style of policing. Where you find scumbags, beat them up, then lock them up.

Too many lawyers and do-gooders getting in the Police's way, and when someone even gets a tiny little bruise, they call Police brutality and then the lawyers flock around like vultures. My family have been London Police officers since Queen Victoria, the only reason my dad isn't one is because in the 70's they rejected him because of his eyesight (no glasses policy in the 60's and 70's). And I get tired of all these rants and raves at Police Officers being the bad guys.

That said this Officer should be discharged the moment the court-case is resolved, while his actions on the scene to me appear justified. To sue the woman who called for your help is just plain disgraceful.

Before a car is dispatched to a disturbance call a dispatcher "always" asks the caller if the person involved is violent, on drugs/alcohol, or armed. So what if this lady, knowing full well he was several of the above, Lied to the dispatcher and said he wasnt? As women often do to protect some schmuck who is beating them. Knowing full well he WAS both violent and high? Should she be held liable then?

And thats my point. All any of you, or me, know about this case is the very little the Lawyers have released to the press, or the very little they released to justify charges. Nothing is really known until there is some kind of Discovery motion and even then finding the truth is often futile.

But your juries full of your peers think nothing of giving away billions of $$ for every scumbag lifer criminal that suffers an injury after picking a fight with the police. Haha , make me laugh more. The saddest thing about talking to brainwashed people is they dont even know they have been manipulated. If you have created this system where anyone can sue anyone for anything then that right belongs to everyone. Even if they are wearing perma-press. This PO went thru a traumatic event and deserves the benefit of the doubt until the actual facts are heard.

Thats the problem with these cop threads. They descend into pizzing matches for everyone that ever got a ticket, got pinched, or a DUI. Not a happy event for them, and God knows not their fault, so why not spend the rest of their lives pizzing on the Police? And even if you didnt every GD news story about the Police is negative, cause thats what sells news, and History has shown us public opinion is very easy to manipulate. Even in a so called free society.

Cap there are times when you have to weigh your safety against the danger to the caller. If he's a deputy help might be minutes away, or many minutes, and you have to make the call whether to go in alone or not. Dont go in and she gets hurt or killed and your screwed. Go in alone and you get hurt or killed and, obviously, your screwed. Either way the mind screwed public will probably bad mouth you. We usually go in, even alone, cause we took the job to serve and protect even at the risk of our own.

Ive lost two friends to gun grabbers at disturbance calls. PM me and I'll send you their pages at "Officer Down". One good friend was killed by a woman who grabbed his gun and shot him in the face. He had been a gunner on a river boat in 'nam and saw more action then anybody here so tell me how it could never happen to you. Ive had offenders try and grab mine 3 separate times. Been shot at 4 times. Cant sit and play the game for long cause I went down a flight of stairs with a wife beater once. I couldnt begin to count all the violent/armed fools Ive had to deal with.

My advice to this young Deputy would be to drop the law suite and become a fireman. Everyone likes firemen. I bet if it was a fireman suing so many of you wouldnt be frothing. :lol
