sound track you tube videos warning.
« on: April 25, 2015, 01:42:26 PM »
when you make videos for you tube we all want our favorite music on them . well some of you may have found out already , and some may find out later the sound track you put in your video may be covered under copyright restrictions . this means your sound track could be removed and your video will be silent. this does NOT mean you are going to be in legal trouble.
1 way to avoid this is to use the audio library that you tube provides
https://www.youtube.com/audiolibrary/music.
there you will see 3 tabs of choices.. free ,ad supported , and sound effects.
the ad supported does come with some guidelines which you can find here.
https://support.google.com/youtube/answer/3376882?hl=en
lets face it we all like our videos either educational or tutorial or our self shooting down the 20 other guys to our favorite songs .but what we dont want to see is.......................

I have had a couple fall under the copyright thing. All I had to do was to acknowledge the copyright claim. I've even had a couple of copyright bots try to claim soundtrack copyright on a video with absolutely no sound, and others trying to claim on Aces High game sounds.

So, check your videos every now and then to see if anyone has claimed copyrights on the audio. I think if it goes unacknowledged for long enough they can and probably will mute it.

There is a way that you can put copyright music in your video. You have to ask the copyright holder for permissions, this is usually easier with smaller artists just because there are less people clogging their system. You will need written permission from these people, more than just an email.

It's also worth noting that they system is not as strict if you don't use monotisation (<--no idea how to spell that word...) on your videos.

I found a video not to long ago about how you could do it, I'll see if I can dig it up and post it here.

I always post the artist/song name in the description, along with "For entertainment purposes only" and none of my videos have been muted.

UMG is on a tear right now had 10 of my videos muted and no acknowledging the claim has no bearing nor will "for entertainment purposes only" nor will having a non monetized account.....per fair use laws.

All based on the copyright holder and when they find your video.

mikev, this is good information and true, however there is another option. When I first uploaded my first video to YouTube I was getting a message that the video was not allowed in some Countries due to copy right laws, but there was a section with that message to protest that, and was given a section where you can click saying you swear you have the right to use it because you legally bought and own the CD/mp3 song. In which I do own the songs I've used because I legally purchased them either by buying the CD or buying the mp3 song off the Internet. But for those who have not legally paid for them, there will be that issue of you legally being in your rights to use a song you don't legally own. As for me when making my films I make sure I add in the credits the Singer/band of the song and the name of the song so there is no mistaken who truly owns the legal rights to such sound tracks for copy right purposes. You as a legal buyer of a song my use such songs, but you DO NOT HAVE THE LEGAL RIGHT TO COPY FOR RESALE OF SUCH SONG OR SOUND TRACKS.
 Just saying!...lol

again that doesn't count just because you own it doesn't allow you to post it in a video and they can mute it if they want.

sorry Draggon but what Vudu 15 is saying is in fact true . unless you are the performer of the song or track or have been given permission by the copyright owner threw the legal process it is and can be removed by the owner of the copyright . I am not saying it will be done right away it could take years. I currently have 2 videos on you tube that fall into this category. 1 is protected by copyright in Germany only for now but if the copyright changes hands it could be removed, "as a humorous side note the song is Voodoo by Godsmack".
so for your own pleasure i would keep a copy of your video for your pleasure viewing . keep in mind there are probably 10000000000000000000000000000 0 you tube videos with soundtracks that are subject to copyright. my guess is vudu15 video was discovered and they went through his entire video collection and picked and choose which ones they wanted to mess with. about the only thing you can do is say this S---- <<<<< S word and either redo the video with an approved sound track or pretend its a silent movie. the only other option would be to attempt to contact the copyright owners and get permission . good luck with that 1

Sorry to tell you, but this is what YouTube is saying when they had me agree to the fact I did buy the songs, once I did, it was cleared up and no future problem, so I hate to tell you, You're wrong!

Just because you purchased content doesn't mean that you own the rights to upload it to YouTube. Even if you give the copyright owner credit, posting videos that include content you purchased may still violate copyright law.

Additionally, recording a television show, video game, concert or other performance with your phone, camera or microphone doesn't mean that you own all rights to upload it to YouTube. This is true even if the event or show you recorded was open to the public. For example, recording a concert of your favorite band does not necessarily give you the right to upload the video without permission from the appropriate rights owners.

I understand that mikev, I'm just saying what happened to me and how it was fixed for me that's all. I'm sure they could do what ever they want its there website. But case in point, what is the difference in using a song from there play list than mine? They don't own the rights to those song either. I'm not trying to argue cause you've done so much for me to get me started making films, I'm just saying that I for me when I got the message I had the option to disagree and they had me click on a button saying that I legally bought the songs from a CD or Mp3 off the Internet ( Not that I owned the rights to the song but I had legally paid for them) via CD/mp3 and everything was fine. I'm just saying this was my experience that's all.
Here is what is called Attributing:

"Attributing" the copyright owner does nothing more than let everyone know that you know you don't own the rights to the work and that you don't have license/permission from the owners.  The fact that you have previously infringed someone's copyright and were permitted to keep the video with no more penalties than it getting adverts placed on it. ( This came straight from YouTube )

Again mikev thank you for everything you've done for me in all of this, and for still watching out over everyone making films....  :salute

good video  explains a lot . tells how you tube does not make the rules about copyright infringement and explains how to contact to get permission before the sound track is erased.

Purchasing music gives you no right to use it in a video, without permission from the copyright holder(s).

Use of copyrighted works, in a video, without permission from the copyright holder(s) is against the law.  No matter what you think Youtube says, it is illegal and makes you subject for legal action.

The only thing that makes it legal for you to use it, is permission from the copyright holder(s).

By the way, I purposely left out any reference to 'fair use', as it is very contentious and will vary depending on which way the wind is blowing, it seems.

However, it is very clear the use of copyrighted music, in a personal video, displayed at Youtube, is quite illegal without garnering permission from the copyright holder(s).
