Udie ... hope you r doing well soon.... but regarding your situation...
my sister is bi-polar ... noone knew till she tried to commit suicide (didn't work thank God). i'll call her tonight and find out about the meds she is on and has used just to give you an idea about what she has done to treat it.

BTW she is doing great now... job at major financial instution doing cust. support and going to school for journalism (she's 22 now) also off meds completely!
 so it shows that this condition is very treatable and bi-polar people can live normal just like all of us... there is NO difference or disability..

DON"T let anyone tell you different!!!!!

called her ... all she ever took was Zoloft.. not sure of the mg but she is off it now and doing fine.
I don't know what to put here yet.

1500 mg would be a rather high initial daily dose, but not unreasonable in the long term.

well I don't think it's a permanent thing.  I started this post durring the constant panic attack I have if not on the freakin xanax the doctor gave me tuesday.  I'm mellowed out now and feel normal.

Christ since age 7 i have been on drugs for depresion. (16 now) Now im having a thing called Fatty Liver...come to think of it i was on 800mg of zoloft at age 9. Now its ritalin and some other stuff. New stuff messed me up real bad one night. Thought i was psycotic. Turns out i had a alergic reaction to this med. Adderol i think it was. Small green thingy. Anywasys enough of my horor storys. Depresion sucks. And after a while on the same meds you kinda flatenout, in a boring druged haze kind of way. But AH can be a treatment to some.

Udie in such cases, you should always get at least a second opinion.

From my experience doctors who experience cases of depression utilize a Knee Jerk perscription response more often than they should.

I know it might be hard to be patient when you arent feeling right, you are just looking for relief.  

But as far suing the doctor, will money make you happy right now?

The most accurate answer to your question is:  it depends (and you wonder why people hate lawyers).  The basic issue is whether your doctor complied with the medical standard of current medicine.  To know the answer to that, you have to have (in most jurisdictions) another doctor testify as to what the standard is (do you prescribe this med on the first date?  or only after some additional testing?  or only when a patient is in a hospital?  or do you start with a small dosage and work your way up?).  Your second physician may be a start.  Beware, however, that it extremely difficult to get a doctor to testify against another doctor.

There is a second theory for many med mal cases, based on "informed consent."  It's the common sense notion that you should be advised of the risks of treatment before you decide to go ahead with it.  I can't tell from your post if your first doctor gave you this info.

Establishing liability (does anyone owe you anything?) is only Part I of a two-part presentation.  The second part is damages.  Assuming you can prove that the doctor did not meet the standard of care, or that he didn't adequately inform you about the meds, what harm has that caused you?  And how much is it worth?  This is obviously very hard to quantify.  Complicating your case is the notion that your case may be worth very little unless you can prove the meds made you permanently worse, which is especially hard to do in emotional/mental cases.  In Philadelphia, as a rule of thumb, lawyers generally won't take a med mal case where the damages are going to be less than a few hundred thousand dollars, because the cases are expensive to prosecute and hard to win.  

That's a general background, perhaps not especially helpful, but it will get you started thinking in the right directions if you choose to go see a Texas lawyer.

Thanks for the reply oldman :) but the drug is out of my system now and I can think normal again (what ever normal is LOL).  The constant panic attack and 150/100 blood pressure is gone FINALY.  Now I'm just left with sleepless nights which is likely due to marijuana withdrawal.  The whole experience with then sucked though and I doubt if I ever seek psychiatric help again.  They are quacks in my book.......
