John Lee Malvo - What to do....

In todays NY TImes, the following quote is presented:

"In discussing the Buchanan slaying, Detective Boyle said, Mr. Malvo was amused by the fact that "after he shot the man, the lawn mower just kept going down the street."

So, should this "kid" get the death penalty?

Just want to hear some opinions.

Why do threads like this always turn into "let's come up with newer more creatively gross ways to kill someone!"

Sheesh.

Eventually some may grasp the concept that placing a value on the haneousness of a crime will serve to inspire for the creation of bigger and better crimes.  Treating the most vile criminals cassually by the letter of the law (exectution in this case) without any more regard introduces a clinical aspect.  You do this and you will die.  No emotion, no celebration, just death.

Fortunately, MiniD, normal people are emotional. The crimes of these two (fill-in-the-blank)s affected almost every thinking person across teh country. It's no surprise to me tha retribution is sought gleefully by so many, including myself.

his lawyers are doing a fairly good job, though.  They are attempting to get the confession dismissed, since he didn't have a lawyer present during questioning.

Have you ever seen a defense counsel not try to get a confession dismissed?  Malvo said, when asked if he understood his rights, that the would say when he didn't want to tell the detective something.  Seems like waiver to me!

Nah... I'm not denying the emotional aspect.  I'm saying that sentancing based on it is ludicrous.  I'm saying that emotion and the courtroom do not mix.  It is because of public sentiment and emotion that the death penalty has become what it is.  Now, its a political tool used by DAs to get re-elected, senators to get elected or governers to get elected.  Haneous somehow makes it more justifiable and the executioner somehow more noble.

I'm sorry, but there is no nobility to it.  There is no redemption in wishing haneousness on someone else.  There is no honor in spewing forth the type of bile that I see in virtually every thread of the same type of subject.  It is discracefull to say the least.

Damn... half the guys getting sentanced to death would be able to get off if they could use emotion as an excuse in the same manner you are right now.

If you think emotion has nothing to do with courtroom convictions, then you are sadly, sadly deluded!  And, people like Malvo deserve neither nobility nor honor, and they also don't deserve to die peacefully and quietly!
