I bought a Alactel DSL modem plugged it in it lit up then I heard a pop and now it will not get any power. I guess its dead? I bought it from a guy off Ebay and payed with a CC via PayPal. Since it is obviously defective merchandise how should I go about getting $$ back. Should I contact the seller first or at all? Should I just call the CC company and file a dispute, or should I go thru paypal? I rarely used Ebay so I am not sure which steps I should take to get my $$ back

First... contact the CC company and protect your money.

Despite my warnings, a friend of mine made a really great deal paying half the price for really cool (but not existing) laptop to some schmuck in Germany.

Pfunk first thing you do is contact the seller and calmly and politely tell him it was DOA, and that you want to return it for a refund. If he does not help you out, then you leave him negative feedback, and you fill out a complaint form against him. Both of those things will encourage him to do the right thing.
If he still does not do the right thing, I don't think Paypal will help you. You can check but I don't think so.
However your credit card company can be helpful in these situations.

Paypal is exceedingly good at chargebacks for sellers...its happened to me and others. We get paid, ship item. Receiver claims its DOA or never gets it, Paypal strives to keep them happy and refunds their money, yanks it from me

Trust me, you arent screwed. But, talk to the seller, see how that goes. Then, if it cant be resolved, call PayPal.
