Anyone get an RIAA supeona yet?
« on: July 29, 2003, 04:56:51 PM »
Fox news just had a middle aged southern truck driver on.

He was supeoned by the RIAA and may be sued for up to $150,000 for each of the 300 songs he's downloaded over his lifetime.

This is RI-GOD-DAMN-DICULOUS!!

What are these money hungry salamanders gonna do? Sue my parents because when my brother was 17, he was downloading songs.

I mean, make you threat, warn people to stop doing or you'll sue, and I promise, many will comply. I deleted Kazaa, and don't swap files anymore.

So I have to worry about some bastard lawyer working for these fat cats sending me a supeona 10 years from now for something I did in the 90's?

What are they going to do, keep a list, and whenever their earnings are a little lite, sue someone?

"Oh, that new J.Lo album aint selling" says fatcat #1
"Screw it, let's sue Bubba Walton from Bumblefruck, Iowa...he downloaded rhinestone cowboy in 1999" says fatcat #2.

Check out http://www.eff.com to see if your on the list.

BTW, the websight is swamped since Fox featured this place...

Guess 60 million americans are all logged in at once, huh.

I just got the results of my search...like a freakin' blood test.

I checked by IP and so far, no supeona.

I can't remember my username, so IP is the best way to go.

I haven't studied this much but here is a question:  If you own a copy of the CD but have downloaded an mp3 copy using file swapping software does the RIAA have a case against you?

I wouldn't think so. After all you actually bought the song.

They have waaay too many fish to fry for those that haven't purchased any of the songs.

I think it could still be a problem because if you used Kazaa or whatever, chances are, you uploaded a file to another user. Therefore, I would guess they can simply assume you copied the CD onto your computer and transmitted it. Copyright infringement.

Since when do "Assumptions" work in a court of law?

Some judge somewhere is going to have to make them toe the mark.

They are going to have to PROVE that you downloaded them or have them illegaly by whatever means.

Not to mention the copyright was not designed for this. It was designed to protect the author for material that was being sold.

Since you could quite legally have

A bought cd,
B ripped mp3's to your hd
C resold CD to someone else.

They have their work cut out for them.

There are a LOT of unhappy people out there right now, does not look good for the music biz imo.

Ghost-

Not knowing all that much about the internal workings of the internet, can't they trace what you downloaded from a file sharing source?

They must be able to, otherwise they have nothing but a guy with an IP who logged onto a file sharing system, and no proof of what he did there.

Is the above correct?

There could be an .txt file or an cookie of sorts on your system that logs what you download from Kazaa

It has to be in your "shared folder" for the RIAA guys to get hold of it tough...

If this is not the case then the folks at Kazaa has to be working with the RIAA as we speak...
