Porsche has prevented a free addon which is featuring their cars from being released for rFactor racing sim.
"EnduRacers Modding Team is sorry to announce that after having been contacted by Porsche AG, the Porsche GT3 Cup Series mod project will not be released to the public. We thank you for your support during the development."

They need to buy a license to use someone else's official product. They are required by law to defend their copy right or they risk losing it.

They are in no risk of losing it. Had this group of modders asked money for their mod things would be different.
Using your logic, world of sims would be hell of a lot duller. I sure hope that most companies, unlike you or Porsche, here uses their common sense.

Porsche has a contract strictly with EA, if anyone wants to use Porsche in a game they have to go to EA. Probably the biggest complaint on the GT5 boards, so RUF is their workaround for GT5.

That sounds like something that probably is related to this. Too bad is all I can say. :(
There has been all kinds of free mods of all kinds of cars/planes in many different sims while especially the same car makes have been also licenced to certain games/game studios. These guys just aren't taking any money from their work but are offering it for free. <sigh>

Electronic Arts reminds us it still has Porsche in Need for Speed series
Do you happen to be a gamer? Are you also a car fanatic? If that's the case, Electronic Arts has a message for you: We still have Porsche.
As we reported a short while ago, Electronic Arts happens to hold the licensing agreement to include cars and trucks from Porsche in its video games. Competitors routinely get permission from EA to include Porsche vehicles in their own games, but when Turn 10, makers of the Forza series, contacted EA in regards to the 35 Porsche models it planned to include in Forza Motorsport 4, EA declined.

I fully understand that licencing agreements that a company has payed good money for to use in their commercial product aren't given away to competitors that also would use them for a commercial product but that has very little to do with the issue at hand.

Yeh, was thinking the same thing aswell. Personally I see it as pure greed and evilness though...and stupidity considering how marginal a single mod for rfactor is compared to the EA sales.
But they can do it and that's enough for them. They know that enthusiasts who do those type of mods on their free time as a hobby for free won't go through a court process. After all their normal, real lifes are more important for these guys and Porsche knows it.

At one time these were all trademarked names, but over time, as they became generic words; they lost their trademarks. Why did they lose their trademarks? The owners didn't defend them. As the owner of a trademark, it’s your responsibility to monitor and control the use of your trademark. If you let infringements of your trademark continue without any response at all, you risk losing the legal right to that mark. If you don't take it seriously, the courts won't take it seriously.

Oh and btw. I fully understand and support Porsche in this particular case. I wouldn't want my ten billion (with a B) Euro supercar business be represented by some non-profit game modders that I have no control over and who have no personal financial stake in the product.

- Forza 4 has Porsches, they arrived as a DLC. :banana:
- Rumor has it that EA's monopoly/contract was ending this year. :angel:

This, Porsche wasn't making any new decision here, just "defending" their previous one of exclusive rights being awarded to the highest paying developer. If I had to bet money and speculate, EA contacted Porche AG about this development or vice versa, Porsche probabley would love the free advertisement, but agreed with EA to enforce/defend their previous (likely handsome) buisness agreement (or get sued and have to pay it all back and then some...).
