Why?  You have to plead voter fraud in your suit first, and then prove it in a court of law.  Under the rules of evidence of a court of law.  Rudy knows they don't have the slightest shred of evidence that wouldn't get laughed out of court.  Even Rudy isn't stupid enough to stand in front of a federal judge and lie.
