You're missing the point. These were classified documents. To remove them and store them improperly and without authorization is a security incident. To do it knowingly, and to share them with unauthorized personnel (IF he did) is a Federal offense. When you have a clearance, you receive training every year on handling of classified (which is marked top/bottom and front/back in red block letters, copy or original). Furthermore, any hand-written notes made from a classified source automatically becomes classfied at the level of the source. Sandy Burgler, er, Berger know this.
While I can believe someone accidently walking out with a classified document, shuffled together with unclassifed documents in his portfolio, it is still incredibly negligent. Stuffing his notes into his pants, jacket, and socks (yes, his socks) is a damning indictment of willful misconduct. At the very least his clearance should be immediately pulled (that's what would happen to me) while the investigation was conducted. Has this happened? Not according to any reports I've seen.
