How can it be two counts of murder? Why aren't abortionists subject to murder charges?

Cal Pen Code § 187 (2004)

§ 187.  Murder defined

   (a) Murder is the unlawful killing of a human being, or a fetus, with malice aforethought.
 
   (b) This section shall not apply to any person who commits an act that results in the death of a fetus if any of the following apply:
 
   (1) The act complied with the Therapeutic Abortion Act, Article 2 (commencing with Section 123400) of Chapter 2 of Part 2 of Division 106 of the Health and Safety Code.
 
   (2) The act was committed by a holder of a physician's and surgeon's certificate, as defined in the Business and Professions Code, in a case where, to a medical certainty, the result of childbirth would be death of the mother of the fetus or where her death from childbirth, although not medically certain, would be substantially certain or more likely than not.
 
   (3) The act was solicited, aided, abetted, or consented to by the mother of the fetus.
 
   (c) Subdivision (b) shall not be construed to prohibit the prosecution of any person under any other provision of law.

So with old Jury foreman, no verdict for days.

Throw two people out and verdict in 1 day?  Wow.

I'd like to see the guy get a nice cold needle and a send off...but I'm also pretty curious what went on in that jury room

I still think he did it based on that because its logical... but logic doesnt substitute for evidence.


My Wife followed this FAR more closely then I did.

From what she was telling me it wasnt just that the entire case was circumstantial.
But it was circumstancial every single step of the way.
Now its one thing if there is circumstantial evidence in one or two steps. But in all of them?
The laws of probability were simply too much against him to reach any  other verdict.
I know I personally didnt hear anything that would lead me to think it could have happened any other way.

Unlike the OJ case which I watched in its entirety.
 While I knew he was guilty, Based on the law I would have had to enter the same verdict they did.
There there was a reasonable doubt. It was unlikely. But it was reasonable.

Lazs, did you see that crowd of man-hating butch dykes, lesbians and abused wives gathered in the Courthouse parking lot? If that verdict woulda come back "not guilty" you'd have seen a riot, no doubt. As it was they had quite the impromptu celebration with lots of cheering, crying and, best of all, sneering- the same way Beatle sneers at Americans- at any males in sight.

When someone convinces me that the soul does not mate with the body until the child draws a breath.  Abortion or prenatal killing equal infanticide in my book.  I think a womens right to birth control is contraception.  To call infanticide "Birth Control" is just a PC attempt to make it sound nicer.
