Insurance is still paying for my medical, paid for the back brace and will pay me for lost wages and suffering. And they promised that when they do ge Mister "NO" Brains the first $500 they squeaze out of him will got to me *Yeah right and Monkies will fly outta my ass*

Our insurance company reimbursed our deductible after they got the other insurance company to pay them for the damages on our truck. In your case it seems to be more a matter of finding the guy first, then squeezing him for the cash.

In our case, the other drivers insurance (All State) was refusing to pay for some of the damages on our truck. Things like, the back of the cab was damaged, one of the rear wheels was bent etc. So I had my insurance company pay to fix our truck, then our insurance went after All State.

All State estimated the damages on our truck to be 1700 dollars. Actual cost to fix it (using used parts) was 2900 dollars.

In the end you should be thankful for those players like us who switch to try and help keep things even because our willingness to do so, helps a more selfish, I want it my way player, get to fly his latewar uber ride.
