Police Handcuff, Arrest 5-Year-Old Girl
'I Don't Want to Go to Jail,' Says Young Student

ST. PETERSBURG, Fla. (March 18) - A 5-year-old girl was arrested, cuffed and put in back of a police cruiser after an outburst at school where she threw books and boxes, kicked a teacher in the shins, smashed a candy dish, hit an assistant principal in the stomach and drew on the walls.

The students were counting jelly beans as part of a math exercise at Fairmount Park Elementary School when the little girl began acting silly. That's when her teacher took away her jelly beans, outraging the child.

Minutes later, the 40-pound girl was in the back of a police cruiser, under arrest for battery. Her hands were bound with plastic ties, her ankles in handcuffs.

"I don't want to go to jail," she said moments after her arrest Monday.

No charges were filed and the girl went home with her mother.

While police say their actions were proper, school officials were not pleased with the outcome.

"We never want to have 5-year-old children arrested," said Michael Bessette, the district's Area III superintendent.

The district's campus police should have been called to help and not local police, he said.

Bessette said campus police routinely deal with children and are trained to calm them in such situations.

Under the district's code of student conduct, students are to be suspended for 10 days and recommended for expulsion for unprovoked attacks, even if they don't result in serious injury. But district spokesman Ron Stone said that rule wouldn't apply to kindergartners.

"She's been appropriately disciplined under the circumstances," he said.

The girl's mother, Inda Akins, said she is consulting an attorney.

"She's never going back to that school," Akins said. "They set my baby up."

they should allow the principals to have their fraternity paddles on the wall in their office like when I went to school.

1 paddling was all it took to get me to respect the other kids and my teachers.
I regret doing business with TD Computer Systems.

Teaching kids to respect others should be done by parents; not by teachers and definately not by a police forces...

I hope if this ever goes infront of a judge somewhere they throw it out and tell the woman to get her kids in line. This is a perfect example of one of the biggest issues in this country, NOBODY is willing to accept responsibility. Its not her childs fault that she assaulted people its the schools fault, you see it everywhere, oh its not my fault im a fat **** who cant control what I eat, its the fast food industry so im gonna sue your ass. People in this country need to start stepping up to the plate and take the **** that comes as a result of their actions.

With a line like "they set my baby up", is there really any doubt?

Hmm ..

I see several people expressing the age old answer to disciplining a child.  Spare the rod spoil the child.

I agree.

HOWEVER!

In several states you use that form of discipline you could find yourself going to jail.

You could find yourself with a crimminal record.

You could even find yourself minus your kids, but still financially responsible for them and anything they might do to someone else.
It's been said we have three brains, one cobbled on top of the next. The stem is first, the reptilian brain; then the mammalian cerebellum; finally the over developed cerebral cortex.  They don't work together in awfully good harmony - hence ax murders, mobs, and socialism.

How very nice of you .... no

The school screwed up, the teacher screwed up ....

and the cops screwed up......

Pathetic ......
and they blame the child .... the education bueacracy is a joke .... your talking about a 5 year old..... OMG they throw temper tantrums .... and you ADULTS deal with it ... if it's a consistant proablem they have 'emotionaly disturbed' special classes for kids that can't hold thier temper....
My mother taught one of these classes, she got beat on by kids reagularly..... She would come home with bruises, but she always managed to contain the situation without arresting the kids..... kids that ranged in age to 5th grade(whatever age that is) alot older than 5.......

She's delt with it .... she never had to call the cops or have these much more violent students arrested .....

Pathetic ......   yes the 5 year old was setup, setup by a crapy education bueracracy, setup by Adults ......

I'd sue the school too ..... that Teacher shouldn't be teaching young children IMHO with an attitude like that ..... children throw tantrums .... it happens.... deal with it or teach highschool kids ... if one of them attacks you .. ya arrest them! .... but a 5 year old .. are you crazy?!?!, or never seen a 5 year old?

You mean you can end up in jail by NOT hitting your kids?

I hope thats what you ment cause thats what you just said

When you spare something you typically dont use it.

That being said I dont give a damn what the laws are in some states. Nobody will ever tell me how to raise MY kid.

They wanna come try to take them fine.

your forgetting who else screwed up..

the Child and the parents.

Its this bleeding heart attitude of not properly diciplining your kids that has juvinile crime at an all time high.

30, 40 + years ago kids would never dare do half the crap they do today cause they know they would get their hides tanned if they did.

Now its "the teachers fault" the cops Fault", "the systems fault"

Everybodies fault cept who did the deed.

and yes children throw tantrums.

Mine have and I've given them a swat for it. No I didnt beat them. I havent ever had to.
And any swat I've given them was no harder then a swat I have given them playing with them.
the only difference is instead of being playful Ive said "there now you have a reason to cry now knock it off"
But they know I wont tolerate it so they dont do it.

Old Family saying. "everyone need a well deserved pat on the back every once in a while its just a matter of a couple feet where"

With reguards to the kid. No charges were filed. And no teacher will ever have to worry about warning her more then once cause now she knows what may happen.

Like I said. some emotional scarring is good.

Kinda like the first time you grab onto a hot pot without checking first.
