California has the same law 647(f)PC which is the inability to care for your safety or the safety of others in a public place... bars that are open to the public agree via licensing they are as public as a sidewalk.

Near riots can be avoided by yanking that one violent drunk off his bar stool.

Morph, I agree that sloppy drunk is too drunk in public. But where is that line drawn in the sand.

Some would say that more than 1 drink an hour or 3 drinks a day is too much. Where your couple of drinks could put you over the limit depending on your size (Im not sure how big an ole boy you are). It may not someone else.

My prob is....who says your too drunk to be in public. I have some friends who can drink until the sun comes up and still seem sober but be WAYYY over the limit. Then others with a lower BAC who are all trashed and cant walk straight. If the people are laughing and cutting up and are over .08 are they publicly intoxicated? I have a problem with this portion of the article.

Just this week I had a couple too many to drive home from the bar. I stayed and played pool for a couple hours till I no longer felt any effects and I was good to go home. Mind you I rarely drink and was prob just over the limit when I decided to stay for a bit. But Should I have been arrested at that moment?

Sure some people are going to drive home drunk, and as you used the gun argument I will fire it back at you... If the laws were more strict against drunk driving maybe less people would do it.   2 years in state 1st offense mandatory.....  

Whos D.D. tonight????   That would be the first question asked.

It's fairly easy to tell who is too drunk[/b] I think. There are several cops in my town who are genuinly nice guys. They have known me forever and basicly kept me out of trouble for as long as I've had my drivers license and could get into trouble in regards to drinking and driving. I'd go out drinking, call one of them up, on duty or not, they'd come pick my drunken sorry bellybutton up and drive me home... and would also break my chops about drinking way more than I should have. I have never gotten a DUI because I do not drive sloppy drunk. It's that simple really. If you want to play that game, you better be prepared to lose. Because eventually you will. (not talking about you, who ever is you).

I come from a long line of alcoholics. But I know where the line is, and I dont cross it when I have to drive. Now, when I'm not driving... that's another story. I once had to stay the night at Wax's house because we drank from 10am to 3am the next morning. That was fun time.

Mistake #1. Thinking you know if you are sober enough to drive. You do not have to be "legally drunk" to get a DWI. Worse yet, you get in an accident and it's automaticly your fault. Impaired and drunk are apples and oranges.

I said, the line is drinking and driving. There is, imo, no middle ground. I just dont do it. It's that simple.

Morph he's right.  Then line is at sober once you take a drink, howerver small, you cross it.  

UNDER THE INFLUENCE doesn't really have a limit if it's up to the officers discretion that you are in fact UNDER THE INLFUENCE.  

You have a beer or two and lets say your BAC is now .05, well under the legal limit and you get in a fender-bender.  The accident is now automatically "alcohol related" and your fault because you are now "under the influence"  

any time you drink and drive reguardless if you are above the "legal limit" you are rolling the dice.

You certainly seem to have a problem with cops in general. Which is sad, because I know, like I said, alot of cops who are good people and would bend over backwards to help anyone out who needs it.

If you need to get drunk, do it at home, where you can then pass out and be a winner. I do think, that if there is a designated driver at the time the cop in the bar is trying to make an arrest, the cops should make the person who is being arrested, and the designated driver, leave.

Just last month my sister and her boyfriend got rear ended by a drunk up near campus. Thankfully no one was hurt. Drunk drivers should go to jail... End of story. It is no different than someone waving a loaded gun around on the street. Someone is going to get hurt... A drunk, behind the wheel is just as dangerous... and both the gun and vehicle the drunk is driving are deadly weapons.



I dont have a problem with cops! you know alot of good cops....great...I know alot of bad cops....young punks that were probably bullied as kids and now that they got a badge...they are now bullies themselves......The law in this country is getting out of control...every time you turn around theres a new law......pretty soon If I look at someone the wrong way I'll be arrested!! If I spit on the street I'll probably get arrested..If I drink 1 beer I can be arrested......If im drunk and walk home from a bar I can be arrested.

Going out, for 3-4 hours on a night, and having 2 maybe beers in that time doesnt fit the parameters for drinking and driving. Is that splitting hairs? I dont think so.

I am fully aware of the laws and liabilities that instantly go along when you take a drink out. I dont need, nor did I ask for a DARE lesson from rpm.

The problem here is not judging if people are too drunk.  I've already stated what the cops are doing, but since no one listens to me, I'll just say it again.


Public Intoxication means being TOO DRUNK TO CONTROL YOURSELF.  It does not mean having a few drinks in a public place.

So.. how do you make out whos too drunk to control themselves? by purposely getting into arguments with them?

Sounds discriminating to me. Some people can hardly handle themselves while being sober and if they drink couple of beers, you'd lock them up for public intoxication?

went out with buddys last week, my friend Nick got followed from the parking lot about 12 miles to his house by two squad cars, he turns into his development and is than pulled over in front of his house....cops cuff him put him in the back of patrol car without telling him anything (said it was a safety precaution) than rip his car apart looking for drugs (found none) after coming up short they told him he was going to jail for DUI..no sobriety test no breathalizer no blood test.no probable cause...he had 4 beers at the bar in 2.5 hours ( i paid his tab so I know) this is close to "legal" limit but no where near impairing..how did cops know he was drinking? by looking through the huge window in front of the bar I presume...btw I got pulled over as well for a busted headlight...guy said "get it fixed" and let me go, so ya never can tell if your gonna get a jackazz or a cool cop

It is a little bit of a judgement call.  But usually, Public Intoxication has Vomitting uncontrollably, Passing Out, Urinating uncontrollably, Yelling really loud, not being able to stand (past the slight stumbling)...  Pretty much the crux of what way way way too drunk people stereotypically do.  They usually just make tulips of themselves.
