What if you really really really meant it. Like it was some sort of cause or higher calling. Would it matter if the other guy wanted to kill you but just didn't have the chance?
Or what if the other guy really really wanted you dead, and you were pretty much ambivalent about the whole thing, but you killed him before he got the chance to kill you or someone else.
Is it murder, killing someone else just because they wanted to kill you? Or does it make you BOTH murderers, since you never would have killed him if he didn't want to kill you first? Or does that make it a murder-suicide? Because if so, a lot of people are gonna get busted because it's against the law to assist suicide.
If as you say, he really really wanted you dead, and in the scenario of say- a stalker, someone who obviously is sick in the head, someone that is virtually anonymous to you, a coward that you have never even meet face to face, but has made death threats over an extended period of time, including half arsed threats with guns from long distance... killing him would be self defence.
Apart from the extended time frame between the events I honestly do not see the difference between killing someone in the situation that I just described and killing an intruder who broke into my home and threatened me with a weapon. In either situation why should I have to risk taking it up the arse? The home invader would just die sooner. As for the stalker, if his fugged up mental state gave me the opportunity or he stops moving long enough, I'll take the shot
morally: I say self defence. Others may disagree.
legally:I don't really give a fug, but you take your chances. Even an assault charge can be sucsessfully defended if extreme provocation can be shown to have caused the assault.
