TOS indicates HTC owns, appropriateness of, usage of, all squad names, player names, aliases of either, inside this game.
Since we pay HTC for access and accept their TOS as part of that contract, we don't have any rights associated to the names we choose other than what HTC grants us. So stated if two groups want to use the name "Flock of Guppies" for their squad name then so be it. It appears only game ID's cannot be duplicated in exact spelling and character case by progrmatical restriction.
Any confusion by using same squad names is prejudiced on the poor judgement of the two groups membership. But, I posit HTC reserves the legal right to deal with either or both parties as they see fit for any acrimonious conduct resultant from said poor judgement. As a response to it's perceived or real negative impact on this community. Including the airing of personal vendetta in this forum and communications channels owned by HTC.
The existing "Aces High construct POTW" good faith membership at the time took our vote for this reason:
Twitchy acted in bad faith to the years of good faith, trust, and community comradery in the construct named POTW by the existing members of POTW during his extended absense from Aces High. Twtichy was accorded a "good faith" postion of Honor upon his return but, in bad faith, without discussion or representation with(to) the whole membership of POTW, or it's existing chain of command. Decided upon a unilateral course of action to remove members in good standing for not fitting his standards for inclusion into the construct named POTW. By a group vote he was ejected for this act of bad faith against the constructs "good faith" membership when they were apprised of his bad faith against their years of "good faith" as members of the construct POTW.
Abadonment of construct can reasonably be argued to Twitchy's long extended period of inactivity and sparce communication with any of the membership of the "Aces High construct POTW" during his extended period of absense from Aces High. Knowing the real person and his contact info of the alias "SYKO" was always available but, person to person contact was sporatic and infrequent. For very long periods of time no one was aware of the staus living or dead of the person aliased as Twitchy. The good faith membership of the construct POTW evolved on as it's own unique entity of freinds and game related interests.
Unrepresented bad faith without resort to review in the face of years of "good faith" membership is wrong in any situation, government, business or social associations. The "good faith" membership rejected Twitchy's bad faith unrepresented conduct within a short interval of his return. The "good faith" membership was not officialy put on notice that some number did not meet Twitchy's standards and would be summarily ejected for no other criteria. Their personal years of loyalty and "good faith" rejected out of hand by Twitchy, after being absent from any part of the ongong growth and "good faith" membership conduct as part of the "Aces High construct POTW". Twtichy's alienated relationship with SYKO and his reasons for that was "not of concern" to the long standing "good faith" membership who had no previous relationship with Twitchy to judge by.
The "Aces High construct POTW" is owned by HTC per the TOS, who by tacitly ignoring this dispute "so far", has no investiture in how it's being used at this time. Rules are in place covering acrimonius and disruptive conduct along with personal grievances in this forum and HTC's in game communications channels.
