This happens a lot. Years ago I got fired on my first day after I told the boss that I would need 2-3 days off in a month because i was getting carpal tunnel surgery. then she told me to get my job back I would need a doctors note. So brought in the note after the surgery and never heard from her again. The moral of the story is never be honest with your employer about your health. Its none of there business unless you need some sort of accommodation to do your job.

Similar thing happened to me.  However, while I was being diagnosed for some things through the VA, I requested an accommodation and was fired.  The reason for being fired was a result of the time needed to get better and receiving treatment.  Once I was fired, I had 30 days to appeal with the appropriatre paperwork.  The doctor notes were not good enough.  I received the paperwork I needed 4 months after the appeal process ended.  Now, I lost my home and my job.  Thing is, my employer is one of the federal agencies promoting hiring veterans.  Politically, they are doing it.  But, once at the local level, they actually target veterans because they block points.  I am among a handful that were fired in the past 12 months.  When I blew the whistle on them, it backfired.  I can't even get a Senator to listen right now.  I am considering bringing in the news agencies...

When I was being re-activated to the corps due to 1st gulf war, my employer said he didn't have to hold my job due to the unknown length of time it would be before I got back. After I got back I was told I was let go due to absenteeism from the job. When I presented all my paperwork to the unemployment department, the guy I was working for subsequently lost his business.

I can feel the pain this guy feels and I hope he gets everything he deserves.

i see what there's 2 codes on that page.  the gm did make a big mistake by writing disabled veteran, he should have only written the codes.  btw the gm doesnt make a decision of firing a store manager without approval from higher ups.  the gm doesnt work there anymore as he "quit" I bet anything it was because of that mistake.

and this is another reason why you should always file an application for familly leave when you need time away from work to take care of your own illness.

he was at that job for two years so he more than qualifies for fmli.  as for the lawsuit, we just gonna have to wait and see what those codes mean.  not knowing what they mean just leads everybody to zoom in onto the "disabled vet" part.  not saying the employer is right, but just wondering what those 2 codes mean.  I am just curious about that.  but to be honest after seeing all the info I really think they let him go because he was taking time away from work.  that isnt right, but he will more than make up with it with the lawsuit due to his boss's mistake.  I hope everything goes his way.

 i thought it was illegal for anyone to fire/lay off an employee due to military service? if it isn't, it should be.

I think the law says you dont have to hold the job but you must give another job of comparable pay but it's only if there are so many employees in your company.

that sounds kinda vague. it should be illegal. someone hired to replace you whilst you're deployed, should only be allowed to be hired on a temporary basis, with full knowledge that you've got your job back when you return from deployment.

 me personally........you're fighting to let me be allowed to own a business? you're dam straight you've got your job back when you come home.

If you knew how ADA laws are enforced, it's in the pipes and doing its thing so to say.  (if you own a buisness, make sure your'e pretty compliant (employees and customers if "retail") before one of these guys fresh outa college shows up with a tape measure or someone drops a lawsuit on you for slipping on an alley cat's furball on your property). 

Odd is the publicity in this case, ADA lawyers or the like are quite adapt/expereinced/proficient at squeezing pennies, without any hype, at least a couple times a week.  And you gotta know what releasing the media hounds will do to this guy's life and buisness in this case (which he would probabley already stand loosing if he was as neive as he sounds).

I find the general disrespect towards Vets and military people in this country to be disgusting.
Don't take it personally, its not hate for vets its love of money that drives most of this kind of behavior of employers...

I have a card that I have carried since I hit my reserve unit after being moved off of AD. It has never been taken out of my wallet until now (so I can show you some pictures :P).

The back (Most of this applies to personnel who are AD and have second jobs as well and those who were deployed and injured/wounded).
Like, ya know, when that thing that makes you move, it has pistons and things, When your thingamajigy is providing power, you do not hear other peoples thingamajig when they are providing power.
