All BS.... The video clearly shows that the Lien had every reason to believe that his family and himself were in a life threatening situation. NYPD and the District Attorney have stated that no charges will be brought. Except for the undercover cops who were there and did nothing. They are likely to be suspended, or even fired. I know, you would have written Lien a ticket or three... Standing over the bleeding and battered driver, "license, registration and insurance card, please." Your reasoning shows me that you're exactly the type of cop I don't want on my streets. I have two brothers on the job, county sheriff and county PD. Both have stated that they believe that Lien did what he had to do... That dirtbag who got run over for blocking the SUV... 12 page rap sheet, dealing drugs, illegal handgun and much more. Yeah, he wanted to detain Lien in the interest of justice.... I hope he enjoys his colostomy bag.

All opinions aside, I am still trying to figure out why the guy went deeper INTO the city  :headscratch:

At what point did he think that he WOULDN'T get stuck in traffic?

I believe that I would have called 911 and stayed on the highway, moving, until I saw a marked cruiser.

 hhmm......video clearly shows bike dude pass too close, pull in front too close, and brake harder than suv dude could have. all the while, there's multiple other bikes in the process of surrounding suv dude. it's crystal clear in the video. not much room for "what if" in there. what happened before the video, (although it wasn't posted for a reason...probably due to the fact that it would further incriminate the bike dudes) is pretty much irrelevant. even IF the bike dudes were wronged just before that, it does not in any way justify what they attempted to do there. once they did that, they put themselves clearly in the wrong. and then proceeded to show nearly 10 minutes of them being in the wrong. criminally so.

 it is. from a "passers by" aspect. i believe(although i could be wrong) that the question was what would he have done in the shoes of suv dude. at that point where they surrounded him. not being armed. with his wife and kid there.

 in my opinion, that was his #2 mistake. the #1 mistake was stopping to begin with in the start of the video.

 if i had to guess, he was looking for a cop. from what i've heard, his wife was on 911 the whole time, but no police in sight. i'd almost bet that he figured if he got off the highway, he'd surely spot an officer that he could seek help/protection from.

If Mr. Lien is held accountable for anything it is a clear indication that your justice systems needs tweaking.

video doesnt matter.  rpm was asking rich what he would have done.  I was asking rpm what he would have done.  like I said, none of us was there.  it's all "what if's" after the fact.

This. The family took the only logical route of escape from an attack. The driver messed up taking the off ramp, but he was on 3 tires and probably thought he couldn't go much farther.
My mind is a raging torrent, flooded with rivulets of thought cascading into a waterfall of creative alternatives.

kinda looked like they surrounded him and were forcing him to slow down/move onto local streets.

I wouldn't count on this skell getting a nickle... Saw his rap sheet. 12 pages long. Several convictions; selling cocaine, illegal handgun among them with many other offenses. His drivers license has been revoked in NY and Mass.

He was committing a felony when we was run over... Justice can take many forms....

It would certainly be an interesting round table to sit in on and given his rap sheet the claimant would not present well on his own behalf, but what we're really concerned with here is this particular occurrence.   

I know insurance companies get a bad rap as "deny, deny, deny" but that's not generally how it goes in a liability claim like this with a relatively young, paralyzed claimant.  I know I've sat in plenty of round tables for questionable liability claims where compromised offers were extended for various reasons.  I don't know enough about the claim to hazard a guess as to how this one might go, but I can guarantee you that if the claimant attorney presents a reasonable demand it would at least be considered.  There are a lot of factors to weigh here.  It sucks sometimes but it is the way it is.

In a situation like that, with your family in the car, the only way you can think to go is 'forward'.. unless you've been trained for such high-stress situations (IE Military, SWAT, so on so forth)

I'll say it again...

1) The bikers clearly intended to cause the SUV to rear end him and was looking back anticipating the collision.
2) Once the family noticed that the bikers were following him, why did he drive further into the city? He should have drove to the nearest police/highway patrol station...

I understand that the driver was stressed, understandably, but as others have stated, why then go into the city?

I suspect that there is more going on than what we all have been informed and without the whole picture we are just blowing steam.
