Per your definition it was a negative comment and they took offense and since there is no gray area a mute is the only course of action. And since there is no gray area all punishments should be the same since gauging the severity of the offense implies there is grayness.
You won't get muted for saying "Your gunnery skills are weak, that's why you go for the HO" It's actually constructive criticism.
Saying "Your mothers skills as a ho are weaker than your gunnery skills", well, yeah, you're gonna get muted.
