does this mean we can sue the car dealership that sold the person the car he was driving when he caused the accident?

The six-woman jury placed 45 percent of the blame on the school board for allowing Brazill on campus with a gun in his pocket to kill his favorite teacher. It said half the blame lies with McCray (gun owner) .

Ok, if I read this right ................

Blame for Murder
gun distrib  =  5%
gun owner  = 50%
school         = 45%
               -------------------
                   100%

So the murdering thug of a 13 year old, Brazill, has 0% blame for the murder of the 35 year old teacher ? Was the jury so stupid they couldn't even add?
Didn't he steal the gun, bring it to school, aim and pull the trigger? (all caught on video tape by the way - not like that matters)

How retarded as a society are we getting....  :rolleyes:

this may surprise some but... I believe that if a person creates an attractive nuisance that he does share some of the blame in an injury or death... say leaving a riding mower running while you go inside to take a call on street full of children.... I don't know the exact circumstances of how the kid got the gun (they say it was in a can loaded where people knew it was there).... I would say that if you left your hunting rifle loaded and leaning on the suv while you went in and put stuff away you would be liable to some degree.  

but.... If you take some sensible precaution like keeping firearms out of sight or behind locked doors fine...   I don't think a 13 year old tho should be able to blame a gun owner for his pre meditated murder spree.

It seems the real focus (according to the lawyer) is to get "junk guns" out of circulation... why this is a good thing is beyond me.

Older pensioners probly can't afford 600 dollar glocks... Is gun ownership and safety dependant on price?     are wealthy people more responsible than poor?  Do cheap .25 autos kill better than 600 dollar desert eagles in 44 mag?   Are they easier to kill with?

Let's say a 16 year-old punk stole the above mentioned riding mower and ran over an old lady killing her.  Should the punk be punished for stealing the mower and killing someone with it?  Yes.  

Should the mower owner be liable because of his/her negligence in leaving the mower running and leaving it unattended?  Probably.

Should the victim's family be able to sue Cub Cadet (the fictional mower manufacturer) for $44 million?  I don't think so.

I agree with Lazs and think that the victim's family realised that they couldn't squeeze anything out of a 13 year-old innercity kid, so they had to find a company to sue.

...well there is actually probably about 130% of total blame, as you have to include the attorney's commission

Let's see...while we're at it...let's see what weelse we can place the blame on.

Let's blame GMC for building a SUV that ran over and killed an old lady. If GMC didn't build the truck, the lady wouldn't be dead!

Let's blame Swanson for making the TV dinners that got American fat, for it they didn't make the dinner...Americans wouldn't be fat!

Let's sue Xexrox for distrubuting the paper that a suicide note was written on, for if the guy can't write a note...he can't kill himself!

How the hell can the gun distrubuters be at fault? All they do is distribute guns to the gun shops, where people buy them. They aren't a fault for "not placing proper safty devices on the gun", the kid's to blame for removing the safety before shooting the gun.

This country cannot think to place the blame on a young child...for we all know children are innocent forever, right? It's the gun makers fault for making a weapon that the student somehow got ahold of and had it somehow discharge at the teacher. We can't bring ourselves to blame children for henious crimes.

We need to start placing the blame where it belongs. If a kid shoots a teacher...it's notvideo games' fault...it's not gun manufacturers' fault, it's the kid's fault. He pulled the trigger...he should be punished...

Because of all these reasons, this judgement will not stand up.  It will be overturned on appeal.  I'll bet $5 that it doesn't even make it past the Fla Supreme Ct, much less get to Federal Ct.  The amount of precedence in other areas of the country will strangle this POS ruling before it goes too far.

the defense lawyer was jumpin up and down on tv all happy as he feels he won with only 5% fee out of the original $75,000,000 the dead guys wife was pushing for....
