Fox News loses
« on: August 22, 2003, 05:44:38 PM »
Haha, Fox News sucks.  This is a victory for all Americans who oppose frivolous lawsuits and the attempts of corporations to quash speech they don't like under the guise of protecting intellectual property.

http://www.cnn.com/2003/LAW/08/22/fox.franken/index.html

Quote
U.S. District Judge Denny Chin, after listening to about half an hour of oral arguments, said the lawsuit was "wholly without merit, both factually and legally."

...

"There is no likelihood of confusion as to the origin and sponsorship of the book ... or that consumers will be misled that Fox or Mr. O'Reilly are sponsors of the book," he said.

As for the trademarked phrase itself, Chin said that it was "unlikely a valid trademark. ... The mark is a weak one as trademarks go."

To the tune of "Love and Marrage"

Fair and balanced,
Fair and balanced.
Empty slogans, rabid views, and shrill rants.
Fox calls critics liars.
O'Reilly's filled with angst and ire.

Fair and balanced,
Fair and balanced.
Words that don't describe the Fox News talents.
Yet, Fox says it owns them.
Sued Penguin Books and wit Al Franken.

Try, try, try to criticize them.
Face litigation.
Try, try, try and you will only get
Big aggravation.

Fair and balanced,
Fair and balanced.
Words that don't describe the Fox News talents.
Don't you try to use them.
You can't say fair,
Not on a dare.
And balanced. Fox is on a mission.

Try, try, try to criticize them.
Face litigation.
Try, try, try and you will only get
Big aggravation.

Fair and balanced,
Fair and balanced.
Ranting righties spouting wingnut madness.
Truth is rarely heard there.
Opposing views,
Authentic news,
Dissenting voices -- Not on Fox air.

You got a be a genuine moron to have any compulsion to read frankens crap.   Unless you just like abusing your intellect and wasting your money but hey, your liberals and that pretty much paints the picture.

Actually I'm not a liberal, and I probably will purchase and read Franken's new book...though I might just check it out from my local library instead.  So, really, did Franken violate your sister or something?

Yes, we "morons" love to read and try to get all sides of an issue to help make an informed opinion.
Yeah, such a stupid thing to do to actually read books from those people/ideas we happen to disagree with

Franken's book will be a great bathroom read.  One  day, you may forget to check that you have toilet paper.  You'll be grateful you bought Franken's book then.

Yeager, you trying to say that your view is the only true view and no other view has any validity? That sounds a bit narrowminded. If you only look at 1 side of a subject you are not getting the full picture. I have not read any of Lies and the Lying Liars Who Tell Them, but I will guess from the title that it will be about the news media. Franken has been inside and around Washington news programs, writers, reporters, ect., enough that he has a perspective on how a story gets on air. I'm sure he has more experience than say, the average BBS poster. Wouldn't it be interesting to hear whats happening to the news before you hear it? If only a portion of Franken's book is actual, you get a broader view to form an opinion instead of being a lemming.

Heh  :)

And the pages also work great as kindling for the chimney fire if the book turns out to be awful.

If you think that reading frankens latest masterpiece is somehow going to give you a broader more informed view of the media and american politics then your pretty ignorant to begin with.

The guy is not brilliant, he is not even above average.  franken is a moron.

Did you read his book yet? So you *know* everything he is going to write?
Truth be told, I wasn't going to even read his book until Fox made such a big deal of it. Now, I'll probably pick up a copy to see what the fuss is about.
I haven't read any of his other books so I don't know him.
I won't make a comment on his book until I've read it though.
To do so I would be making ignorant comments of something I wouldn't (his writing content and style) know of.

How many Harvard degrees do you hold? You may not like his views, but you cannot question the validity of his education and credentials.
