Nope, civilians can take up arms against an invading army and be protected by the GC.
No they can't. They are not LEGAL combatants. Picking up arms places them in a Combatant status BUT does NOT afford them special protection as a soldier under the Geneva Convention.
Now they can declare they are "such and Such" Militia AND declare their uniform. They have to be in UNIFORM before, during and after any combat occurs to be considered LEGAL combatants and entitled to POW status. Again that uniform can be as simple as an armband, as long as it is visible.
Here is the Geneva Convention so you can read it.
http://www.jewishvirtuallibrary.org/jsource/History/Human_Rights/geneva1.htmlPlease feel free to point out the passage where civilians who take up arms are protected by anything special? They in fact are protected, AS are ALL Civilians. They are just civilians who have committed crimes and can be detained and tried.
What is being confused is the fact that EVEYONE is covered under the Geneva Convention. There is NO such thing as not having status. Now that status can change from a protected civilian to a POW to a spy after a trial. Once that trial is legally conducted and it rules you can be executed under it. Civilians taking up arms receive NO special status.
Article 4 covers the detention of civilians in "protected" status.
