I sent Hornet a link by PM that I think he could've used to prove/support this story, and nothing heard.

I now have to raise the BS flag, which is unfortunate.

A.) They instigated, by surrounding him, and verbally threatening him. Hornet's draw was in Self-defence.


No offense Frode but you are mistaken.  If this had actually happened, Hornet committed a crime.  He did not draw his gun in self defense.  There was no immediate threat of serious bodily harm pending as the "assailants" had displayed no weapons of their own and Hornet was in his vehicle, able to avoid the conflict by simply locking his car doors. Let me be clear:  Hornet did not pull his weapon in self defense, from a legal standpoint.

My guess is, that it might be up in the air in a court of law, Steve. That, due to the Verbal threat, and the situation (Hornet had no avenue of escape, save run over the guy in back of him.) Thus, he had very few options' in the situation.

Again, no offense but you are mistaken. The law is clear.  Unless the assailants were actually trying to break into his vehicle, which they weren't,  or unless they constituted an immediate threat of great bodily harm, which they weren't, Hornet is not legally allowed to threaten deadly force and that is exactly what he did when he pulled his weapon.  Hornet committted a crime.

Steve one of the guys was standing behind his truck, blocking the way, from what he said.

It doesn't matter.  Once he entered his vehicle, he was not in imminent danger.

I can't speak for Virginia, but here in West Virginia anyone within 21 feet can be considered an threat.

I enjoy researching law.  Interestingly enough, there is no mention of 21 feet anywhere in the entire West Virginia code.

I looked for that myself shortly after this thread. I'm not sure where the NRA instructor came up with the figure. I'm wondering if this is a case of incorrect info being passed along as fact.

Dang, that would be a bummer for his classes.  Imagine if someone actually  got in a tight spot and used the 21 foot rule to make a decision.
