Also what kind of specs does your computer have? If its weak and just runs Vista it will certainly choke on either Win7 or 8

No, Win7 and especially Win8 are lighter OSes than Vista.

Of course he is.  He is running Vista.  :)

I'd go with Windows 7 64 bit.

If the system is running fine I won't replace the OS unless you want to re-install anyway. If you can get Win7 for a good price - why not. I'd avoid Win8 at all cost.
Just make sure your new OS supports your printer/scanner (or other exotic) hardware properly.

Hasta la Vista  ;)

Win7 64 will upgrade itself from Vista, without damaging your files. Not sure about the win8 though, never had that OS.

Upgrades are often problematic and cause system instability. Best option is always to perform a clean install instead.

As far as hardware is concerned, Win 7 has slightly lower requirements than Win 8.

Benchmarks have shown Win8 to outperform Win7. 'Requirements' do not count.

put win8 on an old dual core amd athlon system with only 2gb of ram and see how well it outperforms anything...

true benchmarks have proven win8 to outperform win7.  which reminds me of back in highschool when I dated a girl "way above my pay grade".  she was hot and I mean really hot, but she was also annoying as hell.  everything turned into a hassle with her.  I dumped her and never looked back.
